I was inspired to look into Chinese Communist Party internal rule/law making by Holly Snapes China Journal article “The Rise of Party Law: Rewiring the Party, Recalibrating the Party-State Relationship”. Abstract below:
Over the past decade under Xi Jinping, the Chinese Communist Party has undertaken a vast, comprehensive, systematic project to build a system of “Party law.” The rise of Party law is at once rewiring the Party internally and recalibrating the Party’s relationship with its state. The result is a potent set of tools for putting into practice the notion that “the Party leads everything,” foregrounding the Party in governance processes, and making Party members and organizations more obedient, pliable and responsive to the Party Center. Party law seeks to manipulate and manage Party members’ and organizations’ behavior as they play an emboldened and more direct role in governing China. This article uses two cases from Party law—new rules on filing and review (备案审查) and Party groups (党组)—to illustrate how Party law is transforming Chinese governance. It finds that contrary to conventional wisdom on “institutionalization,” under Xi Jinping, rather than depersonalizing power, institutions that constrain Party members and organizations are leading to stronger personalization. The rise of Party law relates not only to regime “resilience.” It is geared toward pursuing the agenda and aims set out in the doctrine ascribed to Xi Jinping.

This article helped clarify my thinking on internal Party regulations 党内法规体系. In my translation, I was tempted to think of regulations being zhìdìng 制定 drafted and then finalized in a bureaucratic process stating at lower levels of drafting followed by clearances and then at successively higher levels changes and approvals. In China, Party documents have a legal status, a mix of rule according to law and rule according to Party document so the translation of that word used in this context is formulate or formulation. Which bring me to another enlightening article from the Central Party School — 2017 Zhang Xuebo: Observations on the History of Rule by Document 1982-2017.
Holly Snape in her article mentions that some of the various reviews of Party documents such as compliance with Xi Jinping Thought and current law comes after the Party document is issued and that “the mechanism works by prompting those drafting documents to ensure compliance before issuance”. A remarkable insight. PRC media censorship too is mostly post-publication censorship — fear of consequences of what could happen to writers and editors who let something out that crosses the invisible every-changing line in their desperate effort to get more readers. It works the same way as Perry Link explained in his 2002 ChinaFile article China: The Anaconda in the Chandelier.
Focusing on Party documents and rule-making may seem a bit too far into the weeds, but this particular totalitarian Party is gripping the reins ever tighter as it apparently worries about, in what is put delicately in the document below — Promoting governance of the Party according to regulations and strengthening the construction of the intraparty regulation system is vital for the Party’s long-term continuing governance and national stability, the future of our cause, and the happiness and well-being of the people. Life and death in other words.
Chinese Communist Party General Secretary Xi Jinping has strengthened the Party’s monitoring and control over everyday life, including increased discipline for Communist Party members, to the greatest extent since the death of Mao Zedong. The PRC has been totalitarian since its founding in 1949 with no domestic force capable of constraining its power. Whether control is tighter or looser is a tactical decision made by the Communist Party as it weighs the need to develop the country and increase living standard against the threat from ‘peaceful evolution’ and the spread of alternative ways of thinking among China’s population. Party worries about pervasive corruption are not unfounded.)
Control has gotten tighter since the end of Jiang Zemin’s time — fear aroused by talk of a ‘Beijing Spring’ in 1998 brought some slight tightening. About that time Party control over Chinese universities was strengthened. The real tightening occurred during Hu Jintao’s two five-year terms as Party General Secretary and then in a much sharper during Xi Jinping’s eleven plus years. Xi, like his imprisoned rival Bo Xilai, rhymes somewhat with Mao in his word choice and style. Cultural Revolution experiences perhaps forged the outlooks of both men.
One question one might ask, as China’s political tensions get wound tighter and tighter, is how long does Xi plan to increase this tightening. The April 2023 Party document below suggests this tightening may go on indefinitely. This document likely aims to get discipline in the Party and government tightened up before the next Chinese Communist Party Congress in 2027.
Nearly all the Party internal regulations now being considered for revision were formulated during Xi Jinping’s time as top leader. Several of the Party regulations were last revised just a few years ago. Perhaps benefiting from recent experience or unhappiness with how the last revision worked out?
Tightening discipline helps fight corruption within the Party, fight passivity, rein in grassroots level Party members striving to distinguish themselves by being more Xi then Xi (low level Reds), some leaders quietly sabotaging Xi’s policies (high level blacks ) and combat incorrect thinking. Tighter discipline extends to government as well, as the direct more in the details now supervisory and policy-setting role of the Party is strengthened.
I notice sixteen references to party groups 党组 in the document. Party groups may be established in the leading organs of central and local state organizations, civic organizations, economic organizations, cultural organizations and other non-party organizations. Party groups are responsible for implementing the Party’s lines, guidelines and policies within their organization; discussing and deciding on major issues; bring along non-Party cadres and the masses to take part in tasks entrusted to it by the Party and the State; and guiding the work of the Party organizations of their organization and directly subordinate units. Party groups are an important tool in the Party’s assumption, under Xi Jinping, of greater direct control over central and local government policymaking and operations. Holly Snape discusses party groups extensively in her article.
Training up the next generation of successors is one major focus of the regulations formulation work plan below. Preventing corruption by “making cadres accustomed to working and living in an environment of supervision and restraint.” will be one approach. China is in practice a very decentralized country. Not just on Big Brother in Beijing, but many Little (but locally big in their own domain) Brothers all around the country. When I worked in Beijing in the late 1990s, a Communist Party Central Commission for Discipline Inspection office told me that he did undercover work, going into provincial capitals in the guise of a wealthy businessman looking for high Party and government local officials to bribe.
Wayward diplomats likely inspired the Party to plan to formulate this regulation sometime over the next few years —“Regulations on Regulating the Work, Study, and Life of Spouses, Children, and Their Spouses of Senior Cadres Abroad” 《规范高级干部配偶、子女及其配偶在国(境)外工作学习生活规定》regulating the behavior of senior cadres and their relatives in foreign affairs.

Xinhua News Agency, Beijing, April 18 – Recently, the Central Committee of the Communist Party of China (CPC) issued the “Outline of the Central intraparty Regulations Work Plan (2023-2027)” (hereinafter referred to as the “Outline”) and issued a notice requiring all regions and departments to earnestly implement it in accordance with actual conditions.
The Notice pointed out that the “Outline” is guided by Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era 习近平新时代中国特色社会主义思想 , comprehensively implements the spirit of the 20th National Congress of the CPC, and carries out top-level design for the formulation of intra-party regulations for the next five years. It is an important document that leads to the construction of intra-party regulation systems from a new starting point. The formulation and implementation of the “Outline” is of great significance for deeply promoting the governance of the Party according to regulations, promoting the high-quality development of intra-party regulation systems, ensuring the entire Party maintains a high degree of consistency in thought, politics, and actions with the Central Committee with Comrade Xi Jinping at its core, and achieving the mission and tasks of the Party on the new journey in the new era.
The Notice requires Party committees (and Party groups 党组) at all levels to thoroughly implement the CPC Central Committee’s decisions and deployments on the construction of intra-party regulation systems and the important expositions of General Secretary Xi Jinping on governing the Party according to regulations. They should further enhance the consciousness and firmness of governing the Party according to regulations, strengthen organizational leadership, and implement work responsibilities to ensure the implementation of the “Outline.” Efforts should focus on improving the quality of formulation, continuously perfecting a scientifically sound, strictly procedural, well-supported, and effectively operational intra-party regulation system, ensuring that the formulated intra-party regulations are robust, feasible, and manageable. The key is to ensure implementation and enforcement, highlighting the implementation of the Party Constitution and regulations, rigorously promoting the implementation of intra-party regulations with a spirit of perseverance, and ensuring that all Party members and cadres consciously respect, learn, adhere to, and use the regulations, ensuring the rules exert their power and prohibitions are effective. A systematic concept should be adhered to, and all aspects of intra-party regulation projects, formulation, review, deliberation, approval, interpretation, filing review, cleanup, supervision, implementation, publicity, education, and theoretical research should be comprehensively strengthened and improved. The foundation lies in regulations for improving the Party ‘s leadership system and a complete strict Party governance system. Promoting governance of the Party according to regulations and strengthening the construction of the intraparty regulation system is vital for the Party’s long-term continuing governance and national stability, the future of our cause, and the happiness and well-being of the people. On the new journey, the construction of the intra-party regulation system has entered a new stage of high-quality development, with new tasks of consolidating, expanding, and improving the governance of the Party according to regulations. To deeply implement the major decisions and deployments of the 20th National Congress of the CPC, perfect the intraparty regulation system, enhance the authority and enforcement of intra-party regulations, and further play the role of political guarantees in governing the Party according to regulations, this “Outline” was formulated.
I. Insist on perfecting the “Two Upholds” system to ensure the unity and consistency of the whole Party
Maintaining the core position of General Secretary Xi Jinping in the CPC Central Committee and the whole Party, and maintaining the authority and centralized, unified leadership of the CPC Central Committee is the Party ‘s highest political principle and fundamental political rule. (2) Improve the leadership system of the CPC Central Committee for major tasks.

通知指出,《规划纲要》以习近平新时代中国特色社会主义思想为指导,全面贯彻党的二十大精神,对今后5年中央党内法规制定工作进行顶层设计,是新起点上引领党内法规制度建设的重要文件。《规划纲要》的制定实施,对于深入推进依规治党、推动党内法规制度建设高质量发展,确保全党在思想上政治上行动上同以习近平同志为核心的党中央保持高度一致,实现新时代新征程党的使命任务,具有重要意义。

(二)健全党中央对重大工作的领导体制。坚定维护党中央权威和集中统一领导,制定推动《中国共产党中央委员会工作条例》贯彻落实的配套制度,确保涉及全党全国性的重大方针政策问题,只有党中央有权作出决定和解释。健全党中央总揽全局、协调各方的制度,坚持和加强党中央对党政军群和企事业单位重大工作的领导。健全中央政治局及其常务委员会决策制度,完善党中央重大决策的调查研究、征求意见、听取意见建议制度,健全党中央在领导推进中国特色社会主义事业中把方向、谋大局、定政策、促改革的制度。研究制定《党中央决策议事协调机构工作条例》,健全党中央决策议事协调机构的设立和运行机制,发挥对重大工作进行顶层设计、统筹协调、整体推进、督促落实的职能作用。完善推动党的全国代表大会重大决策部署贯彻落实的工作机制,健全党中央领导实施重大战略的体制机制,推动重大决策部署落地见效。
(三)健全党中央领导各级各类组织的制度。完善党中央对各级各类组织设立和运行的领导制度,强化对机构改革的顶层设计和谋篇布局。完善中央一级党组织向党中央请示报告工作的制度,进一步加强党中央对全国人大常委会、国务院、全国政协、最高人民法院、最高人民检察院党组的集中统一领导。完善中央一级党组织确保党的理论和路线方针政策在本机关本系统本领域全面贯彻落实的制度,推动各地区各部门自觉坚持党的全面领导,坚决维护党中央权威和集中统一领导。
(四)完善党中央重大决策部署落实机制。制定《贯彻落实党中央重大决策部署条例》,强化各地区各部门贯彻落实的政治责任,完善党中央重大决策部署的任务分工、督办落实、定期报告、检查通报、跟踪问效、监督问责等全链条工作机制,确保党中央政令畅通、令行禁止。制定完善督查工作相关法规制度,进一步健全党委领导、党委办公厅(室)牵头抓总、部门分工负责、各方面参与的督查工作格局。制定《规范地方党委政策性文件制定工作规定》,推动地方党委文件精简数量、提高质量、改进文风,切实解决文件配套简单照搬照抄、上下一般粗问题。
(五)健全保证全党同党中央保持高度一致的制度。严格落实《关于新形势下党内政治生活的若干准则》,完善党内政治生活相关制度,巩固和加强党的团结统一,防止和反对个人主义、分散主义、自由主义、本位主义。落实各级党委(党组)主体责任,健全领导本地区本部门本系统全面从严治党工作的制度,确保向党中央看齐,向党的理论和路线方针政策看齐,向党中央决策部署看齐。严明政治纪律和政治规矩,把“两个维护”作为强化监督执纪问责、深化政治巡视和政治监督的根本任务,坚决防止和纠正一切偏离“两个维护”的错误认识和言行,坚决防止和纠正一切形式的“低级红”、“高级黑”。
(六)健全党员干部政治能力建设制度。推进党员、干部政治能力培养制度化长效化,把政治能力作为领导干部的首要履职能力,把增强坚定维护党中央权威和集中统一领导的能力作为各级领导班子和领导干部政治能力建设的首要任务,不断提高政治判断力、政治领悟力、政治执行力,始终做政治上的明白人和老实人。坚持敢于斗争、善于斗争,急党中央所急、忧党中央所忧,健全重大风险防范化解机制,树牢底线思维、增强忧患意识,推动领导干部提高知重负重、知难克难、知险化险的能力,依靠顽强斗争打开事业发展新天地。
二、坚持以完善党的领导法规制度有力保证党总揽全局、协调各方
党的领导是全面的、系统的、整体的,必须全面、系统、整体加以落实。要坚持和加强党对一切工作的领导,健全党总揽全局、协调各方的领导制度体系,坚持在制度轨道上全面实施党的领导活动,完善领导体制机制,创新领导方式方法,把党的领导贯彻落实到改革发展稳定、内政外交国防、治党治国治军各领域各方面各环节,确保党始终成为中国特色社会主义事业的坚强领导核心。
(七)完善党在各种组织中发挥领导作用的制度。强化党在同级各种组织中的领导核心作用,完善党领导人大、政府、政协、监察机关、审判机关、检察机关、武装力量、人民团体、企事业单位、基层群众性自治组织、社会组织等制度,确保各层级各方面在党的统一领导下,各就其位、各司其职、各尽其责、有序协同。健全地方党委对同级人大常委会、政府、政协、法院、检察院党组实施领导的体制机制,加强地方党委对本地区经济社会发展和党的建设的领导。完善党领导群团工作的制度,进一步增强群团组织的政治性、先进性、群众性。
(八)完善党领导各项事业的制度。健全党领导经济社会发展各方面重要工作的制度,把党的领导贯彻落实到统筹推进“五位一体”总体布局、协调推进“四个全面”战略布局各领域各方面各环节。健全党领导全面深化改革工作、全面依法治国工作、民族工作、宗教工作、教育工作、科技工作、社会主义精神文明建设工作、网络安全和信息化工作、生态文明建设等方面的制度,不断提高党的领导制度化规范化程序化水平。制定《中国共产党领导外事工作条例》,加强党中央对外事工作的集中统一领导,维护和塑造良好外部环境。加大党际交往力度,健全党际交往制度,完善社会组织参与国际非政府组织活动等民间外交的制度。
(九)完善把党的领导贯彻到党和国家机构履行职责全过程的制度。把坚持和加强党的全面领导同支持国家机关依法履行职责、开展工作统一起来,科学配置党的机关和国家机关职权职责,进一步明晰权限边界,保证党政机关各司其职、各负其责。加强党对机构编制工作的领导,把机构职责调整优化同完善制度机制有机统一起来,把加强党的长期执政能力建设同提高国家治理水平有机统一起来,深入推进机构编制制度化法定化,巩固党和国家机构改革成果。理顺党政机构职责关系,健全党的职能部门统一归口协调管理的制度,从机构职能上解决好党对一切工作领导的体制机制问题。将党中央决策部署及时转化为法律法规,推进党的领导入法入规,使国家机关依法履行职责的过程同时成为坚持和加强党的领导的过程。
(十)健全提高党的执政能力和领导水平的制度。坚持民主集中制,完善发展党内民主和实行正确集中的相关制度。研究制定《党委(党组)重大决策程序规定》,切实贯彻新发展理念、构建新发展格局、推动高质量发展,问政于民、问需于民、问计于民,加强调查研究、科学论证、风险评估、督促落实,不断提高科学决策、民主决策、依规依法决策水平。完善协商民主体系,推进协商民主广泛多层制度化发展。完善中国共产党领导的多党合作和政治协商制度,推动新时代多党合作更加规范有序、生动活泼。制定《党委(党组)落实统战工作责任制规定》,把党委(党组)统战工作主体责任落到实处。研究制定《健全落实新形势下维护社会稳定责任制规定》,构建党政同责、一岗双责、齐抓共管的风险防控责任体系。健全党员领导干部思想淬炼、政治历练、实践锻炼、专业训练的制度机制,提高领导现代化建设、统筹发展和安全能力,增强推动高质量发展本领、服务群众本领、防范化解风险本领。
三、坚持以完善党的组织法规制度全面贯彻新时代党的组织路线
严密的组织体系是党的优势所在、力量所在。要贯彻落实新时代党的组织路线,聚焦建设堪当民族复兴重任的高素质干部队伍、增强党组织政治功能和组织功能,健全维护党的集中统一的组织制度,为坚持和加强党的全面领导、坚持和发展中国特色社会主义提供坚强组织保证。
(十一)完善党的选举制度。制定《中国共产党中央组织选举工作条例》,着眼党的事业继往开来和国家长治久安,坚持党中央权威和集中统一领导,充分发扬党内民主,总结百年大党选贤任能的显著优势和宝贵经验,将党的中央组织产生程序和机制以制度形式确立下来并加以完善。完善党的地方组织和基层组织选举制度。
(十二)完善党的组织体系建设制度。以制度推动完善上下贯通、执行有力的组织体系,把党的组织优势巩固好、发展好、发挥好。修订《中国共产党地方委员会工作条例》,促进地方党委在本地区更好履行把方向、管大局、作决策、保落实职责,更加紧密结合本地区实际贯彻落实党中央决策部署,更加积极主动谋划推进本地区经济社会高质量发展。制定《新区、开发区、高新区党的工作委员会工作规定》,规范相关党委派出机关的设立和运行。修订《中国共产党工作机关条例(试行)》,体现和巩固机构改革成果。修订《中国共产党支部工作条例(试行)》,完善新经济组织、新社会组织、新就业群体党的组织建设制度,推动党的组织和党的工作全覆盖。探索推进党的组织法规制度法典化。
(十三)完善增强党组织政治功能和组织功能的制度。健全党组织的组织生活、组织运行、组织管理、组织监督等制度,推动党组织认真履行党章党规赋予的职责,从组织上保证党的基本理论、基本路线、基本方略的贯彻落实。健全抓党建促乡村振兴的机制,完善乡镇领导班子、村(社区)“两委”能力提升和管理监督制度。健全以城市基层党建引领基层治理的体制机制,加强城市社区党建工作。完善制度机制,全面提高机关党建质量,推进事业单位党建工作,促进国有企业、金融企业在完善公司治理中加强党的领导,加强混合所有制企业、非公有制企业党建工作,理顺行业协会、学会、商会党建工作管理体制。积极完善“互联网+党建”制度机制,注重运用信息技术手段推进和改进党建工作,增强党建工作的时代性实效性。
(十四)完善党的干部工作制度。坚持党管干部原则,坚持新时代好干部标准,健全干部培育、选拔、管理、使用制度体系,建设忠诚干净担当的高素质专业化干部队伍。修订《干部教育培训工作条例》,完善干部教育培训制度,更好发挥教育培训在干部队伍建设中的先导性、基础性、战略性作用。健全干部考察制度,做深做实干部政治素质考察,画好政治“肖像画”。修订《中管金融企业领导人员管理暂行规定》,推动建设高素质金融企业家队伍。健全年轻干部教育管理监督制度,完善培养选拔优秀年轻干部常态化工作机制,把到基层和艰苦地区锻炼成长作为年轻干部培养的重要途径。完善从严管理监督干部制度,探索加强对领导干部社会交往的监督,让干部习惯在受监督和约束的环境中工作生活。加强公务员法配套制度建设,修订《聘任制公务员管理规定(试行)》等相关制度。
(十五)完善党员队伍建设制度。围绕建设信念坚定、政治可靠、结构合理、素质优良、纪律严明、作用突出的党员队伍,健全发展党员和党员教育、管理、监督、服务制度。修订《中国共产党发展党员工作细则》,加强和改进发展党员工作,进一步提高发展党员质量。制定《民主评议党员办法》,健全党性锻炼制度,进一步强化党员意识、提高党性修养。适应社会环境新变化和党员队伍新情况,探索不同群体党员实行差异化管理的有效办法,健全流动党员、派驻国(境)外机构工作党员、离退休干部职工党员等教育管理制度。完善党费收缴、使用和管理相关规定,提高党费工作规范化水平,增强党费支出的政治效果。
(十六)完善党的人才工作制度。坚持党管人才原则,构建科学规范、开放包容、运行高效的人才发展治理体系,构建适应高质量发展的人才制度体系,完善党管人才工作格局,推动人才强国战略深入实施。实施更加积极、更加开放、更加有效的人才政策,完善人才战略布局,建设规模宏大、结构合理、素质优良的人才队伍,确保党和国家事业发展人才辈出、后继有人。深化人才发展体制机制改革,针对各类人才量身定制管理措施和标准,有效破除人才培养、使用、评价、服务、支持、激励等方面体制机制障碍,激发人才创新创造活力。
四、坚持以完善党的自身建设法规制度坚定推进党的自我革命
全面从严治党永远在路上,党的自我革命永远在路上。要时刻保持解决大党独有难题的清醒和坚定,落实新时代党的建设总要求,健全全面从严治党体系,充分发挥党内法规制度建设作为全面从严治党长远之策、根本之策的治本作用,完善党的自我革命制度规范体系,针对应对“四大考验”、克服“四种危险”建章立制,深入推进新时代党的建设新的伟大工程,保证我们党始终坚守初心使命,始终成为中国特色社会主义事业的坚强领导核心。
(十七)完善党的宣传教育制度。坚持党管宣传、党管意识形态、党管媒体,健全意识形态阵地管理、新闻媒体导向管理、重大舆情和突发事件舆论引导等方面制度,牢牢掌握党对意识形态工作的领导权。制定《中国共产党思想道德准则》,筑牢中国共产党人思想道德高地。制定《中国共产党思想政治工作条例》,完善思想政治工作体系,巩固全党全国各族人民团结奋斗的共同思想基础。制定《党史学习教育工作条例》,弘扬伟大建党精神,完善中国共产党人精神谱系研究宣传阐释机制,持之以恒推进党史总结、学习、教育、宣传,引导党员干部学史明理、学史增信、学史崇德、学史力行,传承红色基因,赓续红色血脉。
(十八)健全党内民主制度。着眼保持百年大党风华正茂和朝气蓬勃,完善保障党员广泛参与党内政治生活的制度,把党内民主贯彻到民主选举、民主协商、民主决策、民主管理、民主监督全过程,切实落实党员知情权、参与权、选举权、监督权等民主权利,进一步深耕党内民主土壤、浓厚党内民主氛围、充盈党内民主空气、提升党内民主效果,充分调动广大党员的积极性主动性创造性,持续激发党的活力和动力。健全党务公开制度,改进党务公开方式,加大党务公开力度,方便广大党员更好了解和参与党内事务。健全党的代表大会代表参与重大决策、参加重要干部推荐和民主评议、列席党委有关会议、联系党员群众等制度,更好发挥代表作用。健全党员旁听党委(党组)会议、党内情况通报反映、党内事务咨询、重大决策征求意见等制度,拓展党员参与党内事务的广度和深度,拓宽党员表达意见的渠道。
(十九)健全纠治形式主义、官僚主义制度。锲而不舍落实中央八项规定精神,抓住“关键少数”以上率下,持续深化纠治“四风”。推动领导干部谋事要实、创业要实、做人要实长效化常态化,完善党密切联系群众的制度规定,强化党执政为民的制度保障,切实做到坚持全心全意为人民服务的根本宗旨、坚持人民至上的政治立场、坚持以人民为中心的发展思想,始终保持党同人民群众的血肉联系,坚决把为民造福作为最大政绩和一切工作的立足点、出发点。健全党组织和党员、干部联系服务群众制度,完善网上群众工作制度,贯彻好从群众中来、到群众中去的群众路线。健全解决形式主义突出问题为基层减负长效机制,有效解决工作中重形式轻内容、重过程轻结果、重程序轻实效等突出问题,教育引导干部把心思和精力用在干实事、谋实招、求实效上来。
(二十)健全反对特权制度。坚持更高标准更严要求促使领导干部保持清正廉洁,健全党性教育、政德教育、警示教育和家风教育制度,督促领导干部提高党性觉悟、珍惜操守名节,坚持严以修身、严以用权、严以律己,坚决破除特权思想和特权行为,以自身廉、自身正赢得自身硬。弘扬艰苦奋斗、勤俭节约作风,从严从紧健全领导干部工作和生活待遇制度规定。健全规范领导干部配偶、子女及其配偶经商办企业行为常态化管理机制,明确领导干部亲属从业限制,严格领导干部身边工作人员辞职后从业限制和从业行为管理监督,切实防止领导干部亲属和身边工作人员利用特殊身份牟取不正当利益。制定《规范高级干部配偶、子女及其配偶在国(境)外工作学习生活规定》,规范高级干部及其亲属涉外行为。
(二十一)健全党的纪律建设制度。修订《中国共产党纪律处分条例》,进一步严明党的纪律,增强党的纪律建设的政治性、时代性、针对性。修订《国有企业领导人员廉洁从业若干规定》,完善国有企业领导人员廉洁从业纪律要求。修订《农村基层干部廉洁履行职责若干规定(试行)》,促进农村基层干部更好廉洁履职。
(二十二)健全党的工作防错纠偏机制。完善规范各级各类党组织的领导活动和决策制度,将民主协商、征求意见、专家论证、合规合法性审查、风险评估等作为重大决策必经程序,在决策后及时进行跟踪评估问效,筑牢党组织防错纠偏的制度堤坝。健全吸纳民意、汇集民智工作机制,推动征集人民建议工作经常化制度化,畅通群众监督、舆论监督渠道,引导人民群众积极建言献策,主动接受人民批评和监督。完善领导班子和领导干部重大决策失误终身责任追究和责任倒查制度,严格落实决策责任。加大党内法规和规范性文件备案审查力度,完善审查标准,健全裁量基准,坚持有件必备、有备必审、有错必纠,有效发挥备案审查的监督功能和纠错作用。
(二十三)健全一体推进不敢腐、不能腐、不想腐制度。健全党领导反腐败斗争的责任体系,建立健全党委(党组)定期分析研判本地区本部门本系统政治生态状况、研究解决反腐败工作中重大问题的制度,完善反腐败工作格局,形成反腐败工作合力。持续健全一体推进不敢腐、不能腐、不想腐的体制机制,在不敢腐上持续加压、不能腐上深化拓展、不想腐上巩固提升,把不敢腐的震慑力、不能腐的约束力、不想腐的感召力结合起来,使严厉惩治、规范权力、教育引导紧密结合、协调联动,推动取得更多制度性成果和更大治理效能。健全查处政治问题和经济问题交织腐败案件的制度。完善惩治新型腐败和隐性腐败制度,建立腐败预警惩治联动机制,有效应对腐败手段隐形变异。进一步规范党政领导干部在企业兼职任职、退休干部经商办企业和社会兼职任职,规范相关行业离任人员从业,整治重点领域和关键岗位“逃逸式辞职”和政商“旋转门”等问题,推动构建亲清统一的新型政商关系。健全风腐同查工作机制,深挖细查风腐同源、风腐一体问题。完善跨境腐败治理工作协调机制,强化对海外投资经营等领域廉洁风险防控,一体构建追逃防逃追赃机制。
五、坚持以完善党的监督保障法规制度持续激发党员干部秉公用权、干事创业
推进党的自我革命,必须坚持以党内监督为主导,实现党的自我监督和人民监督有机统一、良性互动。要着眼强化责任、规范用权、激励担当,不断健全党的监督保障法规制度,形成有权必有责、有责要担当、用权受监督、失责必追究的激励约束机制,确保党和人民赋予的权力始终用来为事业谋发展、为人民谋幸福。
(二十四)完善监督制度。健全党统一领导、全面覆盖、权威高效的监督体系,完善权力监督制约机制,让权力在阳光下运行。修订《中国共产党党内监督条例》,完善以党内监督为主导、各类监督贯通协调的机制,把监督制度优势更好转化为治理效能。完善政治监督制度,推进政治监督具体化、精准化、常态化,增强对“一把手”和领导班子监督实效。修订《中国共产党巡视工作条例》、《被巡视党组织配合中央巡视工作规定》,进一步发挥政治巡视利剑作用,加强巡视整改和成果运用。修订《领导干部自然资源资产离任审计规定(试行)》、《党政领导干部生态环境损害责任追究办法(试行)》,强化生态环境保护硬约束。
(二十五)健全追责问责制度。坚持权责一致、错责相当,进一步完善责任追究制度,推动严肃精准追责问责。制定运用监督执纪“四种形态”的具体政策规定,坚持实事求是、宽严相济、统一规范、公平公正,实现政治效果、纪法效果和社会效果相统一。修订《党组讨论和决定党员处分事项工作程序规定(试行)》,进一步规范党组开展党纪处分的程序和机制。完善涉罪党员刑事处罚与党纪政务处分衔接工作制度,促进执纪执法贯通衔接。
(二十六)健全党的纪检制度。深入推进纪检监察机关规范化、法治化、正规化建设,健全自身权力运行机制和管理监督体系,坚决防止和纠治“灯下黑”,确保执纪执法权正确行使。健全纪检监察机关派驻机构工作机制,更好发挥派驻监督作用。完善中央和国家机关部门机关纪委工作制度,推动机关纪委动起来、硬起来、强起来。
(二十七)健全激励干部担当作为制度。健全崇尚实干、带动担当、加油鼓劲的正向激励体系,加强对敢担当善作为干部的激励保护,以正确用人导向引领干事创业导向,充分调动广大干部干事创业的积极性主动性创造性,让愿担当、敢担当、善担当蔚然成风。完善干部考核评价体系,发挥考核评价“指挥棒”作用,引导干部树立和践行正确政绩观,多谋促发展的实招硬招,力戒博名利的虚招歪招。落实“三个区分开来”,健全容错纠错工作机制,解除干部探索创新、担当作为的后顾之忧。完善被诬告干部澄清正名制度,营造激浊扬清、干事创业的良好政治生态。健全表彰奖励制度,发挥先进典型示范引领作用,激励干部见贤思齐、实干进取。
(二十八)健全党政机关运行保障制度。修订《党政机关厉行节约反对浪费条例》,坚持过“紧日子”,规范和压缩“三公”经费支出,推动节约型机关建设。修订《党政机关国内公务接待管理规定》,完善经费管理、资产管理、差旅、会议等其他制度规定。修订《党政机关公文处理工作条例》,推动党政机关公文处理工作更加科学化、制度化、规范化。健全电子文件管理、密码管理、保密管理、档案管理、党政专用通信、机关事务管理等方面制度,提升安全服务保障水平。
本规划纲要的实施工作,在中央书记处直接领导下,由中央办公厅牵头负责。中央办公厅要加强统筹协调和督促指导,向党中央报告规划纲要的实施进展情况。承担起草任务的部门和单位要强化政治担当,制定工作方案,周密安排部署,认真抓好贯彻落实。规划纲要实施过程中,因情况发生变化需要对项目进行调整的,由牵头起草单位提出调整建议,按程序报党中央审批。
